Scope and information this Privacy Statement covers

The Ábil Score app, belonging to JB CONSULTORIA EMPRESARIAL LTDA, a legal entity under private law, registered with the CNPJ under nº 53.608.291/0001-61, with headquarters at General Osório street, nº 2908, Cabral neighborhood, Zip Code: 64000-580, Teresina/PI, hereinafter referred to as the Company, makes its privacy policy public in accordance with Law 13,709/2018 and subsequent amendments to the following terms.

The website/app may contain links to third-party websites/apps, including websites/apps of our independent partners. We do not own, operate, or control websites/applications of such third parties, or of Company partners. Therefore, this Privacy Statement applies to registered users. 


1. Collection and use of your personal information

We collect certain personal information on our website/application as described herein for the purpose of improving the services we offer, improving your user experience, and providing information about services and products from our marketing partners. This information is obtained when you interact or use the services available on our website/application, such as through cookies and forms. The types of information collected include name, gender, cell phone number, email address, age, geolocation data, company rating on the NPS, information about the network and device used, and access time.

This information is only collected with the user's explicit consent and access to the system is only possible upon acceptance of the terms, which can be done by logging in via the Google or Facebook platforms. It is important to highlight that some data, such as the company's NPS score, geolocation data, gender, reviewer status, and age, can be sold in accordance with the LGPD to third parties.

This information will be used in conjunction with user reviews to provide a quantitative and qualitative view of society's perception of companies listed on stock exchanges, in association with the company's share price. This way, it will be possible to analyze customer satisfaction (NPS) in parallel with the company's performance in the financial market.

By registering on the platform, the user agrees to receive newsletters and periodic communications to their email address. However, you may unsubscribe from these communications at any time by requesting an email.

The user also has the right to request the company about the information collected, the purpose of its collection, as well as the correction, copy, removal, or cancellation of consent for the storage of this data, as established by Law 13,709/2018, within a period of 15 days.


2. Use and sharing of personal information

Regardless of the purpose, whether sharing with service providers or other external entities, we only process and share your personal information in accordance with the terms set out in this document. When we provide personal information to third parties to perform support services on our behalf, we contractually guarantee that they may only access your personal information to fulfill those support services.

Furthermore, we clarify that we do not consider as personal data, when considered in isolation, any information that cannot individually identify the person, such as the name of the company, the website/application, billing data and a generic contact email. We also do not collect any sensitive personal data from the user that is not explicitly mentioned in this document.

Location of Servers and Transfer of Information to the United States. The website/app is hosted in the cloud, and we operate our business nationally, some countries may not provide the same level of data protection as your home country. If you are located, for example, in the European Economic Area or Switzerland (collectively, “Europe”), your Personal Information will be transferred to the United States and possibly other jurisdictions, which are not considered providing an adequate level of data protection. In accordance with local data protection laws, such as the 72 (seventy-two) hour deadline in the GDPR for reporting a data leak.


3. Legal grounds for collecting, using, sharing and other processing of personal information

Certain jurisdictions, including those in Europe, require identification of the legal basis for the collection, use, sharing and other processing of Personal Information. This company relies on the following legal bases for its collection, use, sharing and other processing of Personal Information, as described in this Privacy Statement: registration and monitoring of customer satisfaction (employee of the legal entity or customer) regarding companies that trade on stock exchanges.


4. Your rights over your personal information

You have the following choices regarding our use and disclosure of your personal information: 

Cookies and similar technologies. Please check and adjust your browser or device settings to manage cookies. Below are some cookie-related options you may consider. The user may request the following information from the controller, among others:

  • confirmation of the existence of treatment; 
  • access to data;
  • data correction;
  • anonymization, blocking or deletion of unnecessary, excessive or processed data that does not comply with the LGPD;
  • deletion of personal data processed with the holder’s consent;
  • information about the possibility of non-supply and its consequences;
  • revocation of consent;
  • other legal hypotheses.
  • Right of access: You have the right to obtain confirmation from us whether Personal Information relating to you is processed and to request access to the Personal Information in accordance with clause 10.

    Right to rectification: You have the right to obtain from us the rectification of inaccurate personal information about you. Depending on the purposes of the processing, you may have the right to have incomplete Personal Information completed, including by providing a supplementary statement.

    Right to erasure (right to be forgotten): Personal Information about you may be erased, and we may be obliged to erase this Personal Information, in accordance with Law 13.709/2018.0.

    Right to restriction of processing: Under certain circumstances, you have the right to obtain from us restriction of processing of your Personal Information.

    Right to data portability: Under certain circumstances, you have the right to receive Personal Information about you that you have provided to us, in a structured format, by email, and you have the right to transmit that data to another entity without hindering us.

    Right to object: Under certain circumstances, you have the right to object, on grounds relating to your situation, at any time, to our processing of your Personal Information, and we may be asked not to further process your Personal Information. 


    5. Security

    We value the security and privacy of your personal information. For this reason, we have implemented appropriate technical, administrative, and physical controls to protect your personal information from unauthorized access, use and disclosure. For example, we offer the option to encrypt all information you send to us using Secure Sockets Layer (SSL) technology, which ensures the protection of information during transmission to our website/application. We regularly review our security measures to ensure they are aligned with industry best practices and update them as necessary. However, despite our efforts, it is important to highlight that no security measures are completely foolproof.


    6. Data

    Information that has been anonymized will not be considered personal data, and can be treated in various ways, such as misidentification, addition of noise, pseudo-anonymization, suppression, among other methods.


    7. Children

    This website/app is not directed to or intended for children under the age of 18, and we do not knowingly collect personal information or knowingly track children's use of our website/app. If the Company becomes aware that personal information from a child under 18 has been collected, it will take appropriate steps to delete that personal information.

    Cookies on our website/app generally fall into the following categories:

    Strictly Necessary Cookies: They are necessary for our website/app to function. They include, for example, cookies that allow you to log in to secure areas. These cookies are deleted when you close your browser.

    Functional Cookies: They improve the functional performance of our website/app and facilitate its use. For example, cookies are used to remember that you have previously visited the website/app and asked to remain logged in. These session cookies are deleted when you close your browser.

    Targeting cookies: These record your visit to our website/app, the pages you have visited and the links you have followed to recognize you as a previous visitor and to track your activity on the website/app and other websites/apps you visit. These cookies qualify as persistent cookies because they remain on your device for us to use during your next visit to our website/app. You can delete these cookies through your browser settings.

    Targeting cookies: These record your visit to our website/app, the pages you have visited and the links you have followed to recognize you as a previous visitor and to track your activity on the website/app and other websites/apps you visit. These cookies qualify as persistent cookies because they remain on your device for us to use during your next visit to our website/app. You can delete these cookies through your browser settings.

    Controlling our tracking tools. Your browser may give you the ability to control cookies. How you do this, however, depends on your browser and the type of cookie. Some browsers can be set to reject all browser cookies. If you set your computer to block all cookies, it may disrupt certain webpage features and limit the functionality we can provide when you visit or use our website/app. You can change your cookie settings at any time. Some browsers have a "Do Not Track" feature that allows you to tell websites/apps that you do not want your online activities to be tracked. These browser features are not yet uniform, so we are not currently configured to respond to these signals.

    Controlling Interest-Based Online Ads. We sometimes work with online advertising providers to provide relevant and helpful advertisements. This may include advertisements served on or through our website/app. This may also include advertisements served on other companies' websites/apps. These advertisements may be based on information collected by us or third parties.

    9. Changes or other updates to this Privacy Statement

    We reserve the right to modify this Privacy Statement at any time. If we make material changes to the way we collect, use, disclose or process personal information, we will post an updated version of this Privacy Statement on our website/app and communicate through the controller. Any significant changes to this Privacy Statement will come into effect 15 days after publishing the updated version, or as required by applicable law. When required by law, we will request your prior consent to any material changes made to this Privacy Statement.


    10. Consent

    The user declares that he accepts the collection of the following data: name, gender, cell phone, electronic address (e-mail), age, information about geolocation, company rating in the NPS, information about the network and device used and time at which there was access. This information is necessary so that we can provide the services offered by the Company. The data will only be stored until registration on the platform is completed or upon express request from the user.

If there are changes to the purpose of using the data, which do not comply with the initial provisions, the user will be informed in advance by the controller. The user has the right to cancel access to this information upon free request.

    Consent may be waived in situations provided for by law, such as compliance with legal or regulatory obligations, protection of the life or physical integrity of the holder or third parties, protection of health, regular exercise of rights in judicial, administrative or arbitration proceedings, credit protection, between others.

    If it is not possible to take the action requested by the data subject immediately, the controller will send a response explaining that it is not the correct agent for processing the data and, if possible, will indicate who is responsible. In addition, the legal and factual reasons that prevent the adoption of the requested measure will be provided.

    Requests can be processed electronically or in printed form, depending on the holder's preference. The user has the right to request explanations about automatic decisions that affect their personal and professional profile, as well as the reasons and results of these decisions.
